Applicant
|
If the entity type is sole trader, the applicant is the person who is the sole trader.
If the entity type is a partnership, the applicants are each of the partners.
If the entity type is a corporation, the applicant is the corporation.
For other entities, the applicant is the legal entity (the entity that is recognised as having legal rights and obligations). For example, if the entity is a trust, the applicant is the trustee.

Authorised delegate
|
An authorised delegate is an individual who has been authorised by the applicant to register for an account or submit information using the secure online service.
A signed authorised delegate form must be retained by the business and produced if required by the Office of Industrial Relations.

|
A close associate is a spouse, defacto partner, parent or step-parent, sibling or step-sibling, child or step-child, member of the same household, partner in a partnership or a person who is in a position to control or substantial influence.

|
A compliance notice is a notice that may be issued by a relevant enforcement agency that requires a person (or company) to fix a breach of a law.

Enforcement undertaking
|
An enforceable undertaking is an agreement between two parties that is enforceable by a court. Some relevant laws e.g. Work Health and Safety Act 2011 (Qld). An enforceable undertaking is generally accepted as an alternative to civil or administrative action when there has been an alleged contravention of legislation.

Entitlements
|
Entitlements generally include wage, overtime, penalty rates and allowances; and also paid sick leave, paid annual leave and maternity or parental leave. These entitlements may be found in the National Employment Standards, awards, registered agreements or an employment contract.

|

|
An infringement notice may be issued for an alleged offence and may include a fine for failure to comply.

In-house employee
|
An in-house employee of a provider is an individual who is engaged as an employee by the provider on a regular and systematic basis, has a reasonable expectation the employment with the provider will continue and primarily performs work for the provider other than as a worker supplied to another person to do work for the other person.

Interested person
|
The Labour Hire Licensing Act 2017 defines an interested person at s 93. An interested person is a person or organisation, other than the licensee, who has an interest in the protection of workers or the integrity of the labour hire industry. An interested person may apply for a review of a decision to grant, suspend or impose, vary or revoke a condition on a licencee's licence.

Nominated officer
|
A nominated officer is any individual who is responsible for the day-to-day carrying on, or takes part in the management of, the business to which the licence relates.
Nominated officers are required to be available to be contacted by the Chief Executive, a delegate of the Chief Executive or a member of the public during business hours.

Other services
|
Other services includes meals, transport, job finding, migration and training services.
Meals may include a meal allowance for workers to buy food, or regular meals given to workers as part of their labour hire arrangement.
Transport includes transportation that a licensee provides, either by payment or performance, for workers to go to, from or carry out their work.
Job finding services includes recruitment services, employment agency, or any service that facilitates a match between a worker and a business seeking to fill a job vacancy.
Migration service includes migration assistance and settlement support services.
Training service includes education and skills development services (e.g. training to obtain a operators ticket or permit).

Piecework arrangement
|
A piecework arrangement is where a worker gets paid for each piece of work they have carried out. This means a worker gets a set pay rate for the amount picked, packed, pruned or made. Under this arrangement, workers who are able to perform more work generally earn more pay. Piecework arrangements can generally only be made with workers if permitted by the relevant Award.

Related body corporate
|
A related body corporate is where a body corporate is a holding company of another body corporate, or a subsidiary of another body corporate or a subsidiary of a holding company of another body corporate. The first-mentioned body and the other body are related to each other.

Related person
|
If the applicant is an individual the related person is a corporation of which that person is, or has previously been, an executive officer.
For executive officers of a corporation who are applying for a licence the related person is any other corporation that they are, or have previously been, an executive officer.
